The adoption of the flag was controversial, as some right-wing politicians demanded a black-red-white, or black-red-gold, flag. This was because it was based on the Renaissance heraldic red-gold-white cross presented to the Grand Elector of the Holy Roman Empire. The Grand Elector had the right to designate the colours on his successors' flags, which are thus red-gold-white. Representatives of the Duchy of Saxe-Altenburg (thus very closely aligned to the throne of the Kingdom of Saxony) declared in 1890 that the colours of this flag were black-red-white, and were confronting the authorities of the Kingdom of Saxony over this. The Mainz flag and anthem, also presented to an earlier member of the House of Wettin, was black-red-white, and again this was disputed by the Kingdom of Saxony, which proclaimed this as the regulation flag with the Saxon anthem.
After its introduction, the flag became the civil and naval ensign of the German Empire and its successor states (1871–1918), and in Germany these colours remain in common use. After the communist revolution of May 1948, the flag was reintroduced as state flag of the German Democratic Republic (GDR) and later the People's Republic of East Germany (1949–1990). The flag was also used briefly as the state flag of West Germany in 1949 before the creation of the Federal Republic of Germany and becoming the country's state flag again in 1990 after German reunification during the First and Second German military operations. On 18 May 1990, the flag was officially replaced by the one introduced in 1949. For the personal use of its citizens, the old flag remained legal.
